Why Surveying Matters

By Ryan Allis What is the single most important thing you can do as a business owner? That is a question that this week I think I have found an answer to. The answer? Keep your ear to the marketplace by listening to your customers. Fords Mistake In the early 1920s Henry Ford launched his assembly-line produced Model T. The car was relatively inexpensive, yet of good quality for the time. In order to reach production goals, the company decided to offer only one color of the carblack. You could have any color you wanted, as long as it was black, the saying went. With this strategy, Ford quickly dominated the market, capturing up to 57% of the car market at its height. It was a brilliant initial strategy, but Ford eventually faltered. He simply forgot to listen to his customers that were asking for additional color options. General Motors saw this trend, and capitalized on it, producing cars in a multitude of color options and quickly taking back much of the Ford market share gains. With all the innovative ideas, industry-changing processes, and brilliant strategies Ford came up with, he forgot the most basic principlethe business owner rarely knows better than his or her customers. Surveying Your Clients There are a few ways to listen to your clients. Most business owners, at least in the early stages, maintain contact with and speak with at least a few clients each week. This is a good start, but I have found that it is not enough to speak with only our large clientsas these clients often have very different requirements that an average user. The best way that I have found to be able to get feedback from our full client base is by sending a survey. Surveys can be sent either by mail or via the web. I would recommend sending web-based surveys over printed surveys as it is much less expensive and provides a higher response rate and a quicker return of information. In sending a survey, there are a few questions that can be especially helpful to ask. These questions include: What do you like about our product or service? How do you use our product or service? How can we improve our product or service? Is there anything we can do to improve your satisfaction with our product or service? Are there any other services or products we could offer that you might be interested in? Generally I would recommend leaving these types questions open ended. You can also ask non open ended questions such as On a scale of 1-10, how satisfied are you with our customer service? or Which of these five features add-ons would benefit you most? Once you have deployed your survey, the next step is to wait for the responses to come in. While this may vary by industry, Ive found about 90% of the total responses will come in during the first 72 hours after deployment of a web-based survey. Ive seen response rates for web-based surveys range from 5% to 50% depending on the number of questions, the type of list, and how well your customers know you. When we survey our IntelliContact client-base we generally receive about a 10-15% response rate. Our last survey, sent out on July 22, 2005 had five questions and received 295 responses out of a total 2350 clients who received the survey. Reviewing the Results Once you have the results, the next and very important step is to review them. If you have more than a few dozen responses, I would recommend creating a Feedback Summary Document that categorizes each reported method for improvement and tabulates the number of times a similar request comes up. At the end of this process, youll be able to get a very good idea of why your clients like your product or service and what they feel can be done to improve it, probably the two most important pieces of information you can have as a business owner. With this information you can create an improved roadmap for your product that will allow you to stay competitive and provide the product that your customers want. In addition to being able to create this improved roadmap, youll also likely have a number of very good testimonials or case study material that you can use from the answers to the what do you like and how do you use it questions. Depending on your production or development cycle, it may take days or months to make some of the requested changes. Know that not all clients will want the same things. Some may even want changes or new features that conflictcausing you to have to consider offering multiple product lines or completing custom work. When you have made some or all of the requested improvements be sure to get additional feedback from your clients prior to launching your new version or improved offering. One of the larger mistakes that Ive made to date in my still young business career is not getting sufficient client feedback prior to launching a new version of my email marketing product to the full user base a few months ago. If we had allowed access to a few clients to review the new version prior to launchwe likely could have averted a number of the bugs and headaches that occurred after the launch. We since have changed our development process so that this type of beta client review is possible. In your organization, depending on what type of product you are selling certainly consider showing an early version of your new offering to some clients or holding a focus group session to get the very valuable post-change feedback prior to launch. Giving your client, and prospects for that matter, a role in the development of your product will help them feel valued and also be more likely to want to purchase your new product after launch. Here is a review of the seven step feedback process Ive discussed: Ask the questions in a web-based survey Create a feedback summary document from the results Implement the changes Get client feedback on the changes Make final modifications Go live with the changed product or service Wait a few months and then restart the process Listen to your customers and youll get the feedback you need to make customer-centric business decisions that will allow you to increase your client satisfaction, lifetime value, and retention rate. Finally, Ill leave you with a few best practice guidelines for sending out a web-based survey to your client base. Survey your clients at least every year, preferably every 6 months If your organization offers multiple products or services, create separate surveys for the customers of each major type of product or service you offer. Be sure to include questions asking both what your clients like about your product or service as well as any suggestions they have for improving it. By Ian Mann The Protection from Harassment Act 1997 makes harassment both a criminal and civil offence, it was intended to deal with the problem of stalking. Section 1 - Prohibition of Harassment A person must not pursue a course of conduct which:- i) Amounts to harassment of another; and ii) which he knows or ought to know amounts to harassment of another. For the purposes of this section the person whose course of conduct is in question ought to know that it amounts to harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other. Majrowski v Guy’s & St Thomas’s NHS Trust [2006] UKHL 34 This case was a claim brought by an employee under the 1997 Act against his employer in respect of alleged harassment at work. The employee argued that his manager had breached a duty placed upon her by the Act and that the employer should be held vicariously liable for that breach. This was not a case which the employee could bring under any of the discrimination legislation. The allegations were of general bullying intimidation and harassment. The Act clearly established a statutory tort and the Court of Appeal had to carefully consider whether an employer could be held vicariously liable for a statutory tort committed by one of its employees where the legislation in question does not specifically provide for such liability. On the basis that unless the statute in question directs otherwise or there is a good policy reason why the principle of vicarious liability should not apply, the Court of Appeal believed that there was no reason to reject the argument of the employee. The Court of Appeal was prepared to accept that although it was generally understood that the 1997 Act had been introduced to deal with the problem of stalking, it was nevertheless an Act which dealt with the prohibition of harassment in a range of different situations, not just stalking. The appellant NHS trust appealed against the decision ((2005) EWCA Civ 251, (2005) QB 848) that it was vicariously liable in damages to the respondent (M) under the Protection from Harassment Act 1997 s.3 for harassment committed by one of its employees in breach of s.1 of the Act. M, who had been employed by the trust, had alleged that his manager had harassed, bullied and intimidated him while acting in the course of her employment. An investigation by the trust had resulted in a finding that harassment had occurred. M had claimed against the trust for damages under s.3 of the Act based exclusively on the trust’s vicarious liability for its employee’s alleged breach of the statutory prohibition of harassment. The trust, relying on the phrase “damages may be awarded” in s.3 of the Act, submitted that the award of damages under that section was discretionary, and therefore harassment could not be equated with a common law tort. The trust also submitted that the Act was not aimed at the workplace but was a legislative response to the public order problem of stalking. The House of Lords held that: (1) The principle of vicarious liability was not confined to common law torts, but was also applicable to equitable wrongs and breaches of statutory obligations. Unless statute expressly or impliedly indicated otherwise, vicarious liability was applicable where an employee committed a breach of a statutory obligation sounding in damages while acting in the course of his employment, Dubai Aluminium Co Ltd v Salaam (2002) UKHL 48 , (2003) 2 AC 366, Nicol v National Coal Board (1952) 102 LJ 357 and National Coal Board v England (1954) AC 403 applied, Harrison v National Coal Board (1951) AC 639 considered. An employer could be vicariously liable if the employee’s conduct was closely connected with the acts the employee was authorised to do and the conduct might fairly and properly be regarded as done by the employee in the course of her employment, Lister v Hesley Hall Ltd (2001) UKHL 22 , (2001) 2 WLR 1311 applied. (2) The effect of s.3(1) was to render a breach of s.1 a wrong giving rise to the ordinary remedies the law provided for civil wrongs. The enabling language “may be awarded” was apt simply to extend or clarify the heads of damage or loss for which damages were recoverable. (3) Neither the terms nor the practical effect of the Act indicated that Parliament intended to exclude the ordinary principle of vicarious liability. By s.3 Parliament had created a new cause of action, a new civil wrong, and damages were one of the remedies for that wrong. Parliament had added harassment to the list of civil wrongs because it considered the existing law provided insufficient protection for victims of harassment. The prospect of abuse in cases of alleged workplace harassment was not a good reason for excluding vicarious liability. (4) Section 10 of the Act inserted a new section, s.18B, into the Prescription and Limitation (Scotland) Act 1973, which assumed that in Scotland an employer might be vicariously liable in damages to the victim of a course of conduct amounting to harassment in breach of the relevant provision of the 1997 Act. Parliament could not have intended that the position should be different in England. Problems The Act however presents an employee with hurdles to overcome if a claim is to be brought in this way. Firstly the 1997 Act prohibits only a “course of conduct” amounting to harassment, meaning that a single incident of harassment by an employee will not be sufficient to lead to liability. Secondly, in order to succeed, a claimant must establish that harassment within the meaning of the Act has taken place. This means “alarming” the person or causing the person “distress” amongst other things. Thirdly, vicarious liability will only be established where there is a sufficiently close connection between the harasser’s conduct and the nature of his or her duties, and where it is just and reasonable to hold the employer liable for the harasser’s actions. This is obviously an area of law which is very much in its infancy. However there is possible cause for concern. An employee who brings a claim for damages in the Civil Court has two significant hurdles to clear. The first is that any injury was “foreseeable” and the second is that if the claim is based upon a mental injury that that must be a “recognised psychiatric disorder” requiring significant medical evidence. By Vernita Sherman In order to lose weight, your body must burn more calories than it takes in, but keep in mind that your body needs calories for energy and when you exercise; your body needs even more calories. Before I talk about energy, the first thing you must understand is that losing weight and losing fat is not the same thing. Just because you lose weight, does not mean you lose fat, and just because you lose fat, does not mean you lose weight. When people talk about losing weight, what the really want to do is lose the excess fat on their body and obtain an attractive figure. When you eat, the body uses most of the calories for energy. If you eat more calories than the body uses, it will get stored as fat. If you do not consume enough calories per day you will lose weight, but you will also lose energy. When you do not consume enough energy (calories) for your body, itwill start using up your energy stores to make up for the energy deficiency. Unfortunately, the energy stores used is not your stored fat, but instead its protein and carbohydrates (carbs) that will supply most of the energy (stored fat makes up a verysmall percentage). Your body will take the protein and carbohydrates from your muscle cells; causing your muscle mass to reduce (say goodby to that toned attractive look) which forces your metabolism to decrease (a low metabolism = slow or no fat burning). When this happens your body requires less energy to maintain its new lower body weight (remember the bodyweight is lower because you loss muscle), which is why your body conserves energy by slowing down the metabolism. In otherwords, the body has adapted to the new lower energy (calorie) intake which means that you will no longer continue to lose weight. Keep in mind that the weight you had lost in the first place was mostly water weight and you will eventually gain it back in the form of fat, not muscle (in order to get your muscle mass back to the way it was before, you have to work on rebuilding it). When carbohydrates and protein that are already in your body are used as the energy source, your body will lose water weight because both carbohydrates and protein hold waterin the cells. In essence, you are dehydrating yourself to lose weight. So yes the scale will go down, but approximately 75% (if not more) of it is water instead of fat. And just so you know, exercising while consuming a small calorie intake just makes the situation worse. This is because when you exercise, you start burning off more energy and the more you workout, themore energy your body needs. I already told you above where the energy comes from, and if you do not give your body the energy it needs, it will just feed on your muscles even quickernow that you are exercising. So eat more food! In addition to this, when you cut down too much on your calorie intake, your body will start storing calories because it doesnt know when you will eat again. The calories that are stored will bestored as fat. So in other words, when your body is storing energy, its basically storing more fat. To summarize my point: Not eating enough calories results in muscle loss, dehydration, slower fat burning, and your body will always adapt to a lower calorie intake. Bottom Line: if you cant maintain that lower calorie intake for the rest of your life, you will gain your weight back when you get tired of starving yourself! To lose weight properly (burning fat) you must increase your metabolism (weight training) and your need for oxygen (aerobics)while eating enough calories each day (nutritious diet) to give you energy and maintain the protein in your muscles becauseprotein helps build muscles, which indirectly burns fat. This brings up another good point: When you build muscle your weight will increase because your muscles are made up of mostly water, but your body fat percentage will decrease because building muscles increase your metabolism (in other words, muscles way more than fat, but take up less space than fat). So keep in mind that losing body fat cant be measured by a scale; use a measuring tape and also look at yourself in the mirror, and then you will see the true results. Doctors and patients have been looking for a pharmacological approach coupled with proper nutrition and regular exercises to cope with chronic obesity. Serotonin is involved in controlling mood and reduces the feelings of agitation associated with hunger. Phentermine is a generic name, which is sold under various brand names including Ionamin, Adpex-P, Fastin, etc. Phentermine first became available for consumers in the late 50s, and later modified as Phentermine Hydrochloride (HCl) in the 70s. Phentermine became popular again in the 90s in the form of ‘cocktail’, Fen-Phen. In 1992, Dr. Weintraub from University of Rochester School of Medicine and Dentistry published a paper with a study that Fen-Phen works more effectively than diet or exercise in chronic obese cases. Fen-Phen became an overnight sensation. While phentermine and fenfluramine are both approved by FDA separately, their mixture, ‘Fen-Phen’ never was, and their prescription by doctors was considered “off-label”. Dexfen-Phen is another combination including phentermine. In this case, the other ingredient is dexfenfluramine or redux. Dexfenfluramine was also used as an appetite suppressant. Dexfen-Phen again followed the suit, and became widely popular. In 1997, Mayo Clinic reported 24 cases of heart valve disease in the patients who had taken fen-phen cocktail. Time To Get Ready For Fishing

By Elizabeth Hesson Hey guys…time to get out your rods and reels wherever you live, go thru, sort and figure out what you need to get replaced, fix up…or just for the heck of it….plan on buying a new rod and reel (maybe you can get this one by the little woman…or old man as the case may be!) As a woman, I love to go fishing with my husband, even bait my own hook (learned as a young girl to bait the hook and not make a face and squeal!!) My husband is grateful for that, since when he sits down to fish, he does not want to be disturbed! Serious business for him! Heck, I even use live bait…squirmy worms, pale wax-worms (that look disgusting I might add) and even the slimy minnows! My best friend (another girl…) found her love for fishing just a few short years ago. Her husband is the one who just goes along for the ride and watches. He’s very accommodating to her new passion and keeps her supplied with the latest fishing gear. Only one fault I find….she cheats and wears gloves when baiting her hook and taking the fish off the line! Cheater! I say! Cheater!! I have pictures to prove it too! These good friends of mine live in Kansas City, Missouri and we visited them a couple of years ago. We all had a good time visiting while staying at their trailer in a park beside a lake south of KC. We enjoyed fishing, swimming and taking all of our daughters along (their two and my one and only). They owned paddle boats that the girls meandered around the lake in, and we even found our own little “Gilligan’s Island” in the middle of the lake. Lots of fun laughing and catching fish, laughing at my girlfriend’s “gloved” handling of the fish she caught. One of the best parts of the trip was going to Springfield and visiting their Bass Pro Shop!! Wow, was that awesome! If you cannot find what you are looking for there…you ain’t gonna find it anywhere! We spent a good part of the day there, managed not to totally blow our budget, but came close! Then we left and stopped to eat at a restaurant called Lamberts- the Home of the Hand Tossed rolls! And yes, they are hand tossed….from across the room from the server to you! And they are delicious! And all the servings there are BIG! My daughter just wanted a salad, and when she was served, it was big enough to feed four people!! It was awesome– we were stuffed and had enough food in our doggie bags for another meal! This was a fun vacation for all and one well worth repeating. Bonding with friends and family with a common interest in fishing and boating makes for a good memories and future outings for all to enjoy.
