Not only do you have to deal with dry, itchy, and sometimes red skin, you have to be careful when choosing skin care products because many of the chemicals can irritate your delicate complexion. But Im here to tell you that as long as you know how to take care of your sensitive skin, youll find that living with it isnt so bad, and that one day you may in fact learn to love it. Its important to find out what type of sensitive skin you have. Do you sunburn easily? Is your skin often itchy? Do you blush easily? If you answered yes to these questions then most likely you were born with sensitive skin. If your skin only seems to react to certain skin care products, stressors, or foods, then its probably only triggered sensitive skin. This type of skin can be managed by avoiding the products that cause irritation. Probably the biggest thing you can do for your sensitive skin would be to keep it moisturized. Since this type of skin typically tends to be dry as well, the proper moisturizing lotion is very important. Find a cream that has been dermatologist-tested or says for sensitive-skin directly on the bottle. Remember to use fragrance-free lotions, creams, soaps, and shaving gels because the added fragrance can irritate your skin. Controlling breakouts can be another battle for people with sensitive skin, because many of the bacterial-fighting chemicals in standard acne treatments are too harsh on your skin. MIT Technology Review Concern Over WARF Patent Royalty Demand To CIRM Over Stem Cells Is Misguided

The article mentioned a possible gambit by the state of California to ensure cooperation among researchers of different states. The oversight committee of California’s CIRM recently announced that any California researchers who develop patented discoveries using California state funds must share their patents with other state researchers. Ed Penhoet of CIRM was quoted: “We hope WARF will reciprocate.” Of course, one issue is that WARF presently has patents related to embyronic stem cells, and CIRM does not. Further, one would need to know details of what is shared. Does the sharing only pertain to the use by researchers in academic institutions, or does it extend to companies created by such researchers? One of the prime selling points to voters of states such as California and New Jersey was that the state funding research would recover expended money through patent royalties. If everyone gets a free license, such a recovery is unlikely to happen. The article goes through the world of patent useage as among different patent-holding universities. Universities generally allow other institutions to use patented technologies without special permission. The litigated case of Madey v. Duke University is an exception to this general rule, although it was a patent-holding professor who sued a university. Furthermore, WARF requires universities to get a license to do embryonic stem cell research. “None of us understand why we need a license…Why is this technology any different?” says one technology-transfer official. The license of WARF to the University of California, for example, permits scientists to use only a small number of embryonic stem cell lines. And the license granted to the Howard Hughes Medical Institute, a nonprofit medical research organization that funds scientists across the nation, prohibits scientists from accepting funding from or collaborating with commercial companies unless the company has a commercial license from WARF. The article presents an interesting quote by Jeanne Loring, who herself is an author of an article criticizing the WARF patent royalty demand [311 Science 1716 (2006)]: Jeanne Loring, a scientist at the Burnham Institute for Medical Research in La Jolla, CA, started a short-lived embryonic stem cell company several years ago. “I learned from venture capital investors that these patents existed and that it would be impossible to obtain funding from them,” she says. This quote is significant for at least two reasons. First, one sees that venture capitalists were aware of the Thomson/WARF patents and saw them as a show-stopper as to VC investment in the field. Thus, as to small research entities spurning money from CIRM over disputes about patent royalty rights, one suspects such small entities do NOT have VC funding as a viable alternative. I suspect the length of time before payout is separately a showstopper as to VC funding; nothing here looks ready for commercialization within seven years, a typical VC benchmark. Second, in the world of Bayh-Dole, it’s kind of scary that one professor/entrepreneur would not know of relevant patents of a Bayh-Dole grantee. Further, it’s also scary that CIRM apparently had not anticipated the WARF play, which failure is somewhat hard to fathom since the basic patent issued years ago. The basic WARF/Thomson patent is US 5,843,780 (issued 1 Dec 1998 to James A. Thomson, based on application 591246 filed 18 Jan 1996; the application was a continuation-in-part of U.S. application Ser. No. 08/376,327 filed Jan. 20, 1995. It was obtained with funding from the federal NIH, and thus represents a patent obtainted through the auspices of the Bayh-Dole Act. It is separately true that Thomson, a few days after filing his basic patent application, submitted a paper to the Proceedings of the National Academy of Sciences, which appeared as 92 PNAS 7844 (1995). His effort at patenting did not impede his efforts at rapid public disclosure. Kenneth Taymor, an attorney with the Stanford Program on Stem Cells in Society, is quoted in the article: “The more that WARF presses its rights, the more research will be impinged and the more likely it will move offshore.” This boogeyman won’t hunt. In a different variant, research was going to move offshore after Bush’s restriction in 2001. Taymor and the article author Emily Singer simply neglect to mention the role that 35 USC 271(e)(1) is going to play in research on embryonic stem cells. Therapies arising from embryonic stem cells are going to need FDA approval. Work done to meet FDA requirements is insulated from infringement liability through the safe harbor of 271(e)(1), as expansively interpreted by the U.S. Supreme Court in the case Merck v. Integra. Do More of What You Want: Making Time Work for You

By Allison Shields One of the biggest challenges lawyers face is the challenge of trying to get it all done and still have time to do the things they want to do. Theyre overwhelmed by the demands of their practice and juggling family, personal and work time. Theres really no such thing as time management Time management is a misnomer. You have no control over time. Everyone is given the same amount of time every day, every week and every year. Whether you like it or not, youre stuck with only 24 hours every day. Rather than thinking about managing your time, think about managing your activities. Often, the problem is that lawyers are afraid to plan their activities within the amount of time available to them. Many lawyers think that their practice doesnt lend itself to planning because they want to be responsive to clients needs as they arise. The two do not have to be mutually exclusive. Unfortunately, having no plan at all usually means that the little, often least valuable or least important things eat up all of the available time, and important tasks never get done. Sometimes, its marketing, organizing your practice or your office, or following up on collections that gets neglected. Most often, its the family and personal time that suffers. Lawyers become victims of burnout, which leads to more profound personal problems and ultimately, health problems, in addition to business and professional troubles. How can you manage your activities to create time for high value business and personal activities? Theres no one right way to do this that will work for everyone. And there is no one right tool, whether you use case management programs, electronic databases, personal handheld organizers, desk calendars or paper planners. But regardless of which method you choose to manage your activities and appointments, the steps are similar. First, divide your activities/tasks into categories Julie Morgenstern, author of Time Management from the Inside Out and other books, likens organizing your activities to organizing your closet. She begins by sorting putting like items together. For example, you might sort activities into categories such as: errands (post office, dry cleaner, banking), closing files, entering contact information into your database, planning, filing, family activities, writing, blogging, etc. The categories are extremely individual and may depend on your practice area and other obligations; these categories are just suggestions. Break up your to do list. Looking at the entire list of everything that needs to get done, from errands to client projects to marketing and administrative tasks can be overwhelming. And overwhelm leads to paralysis. By categorizing the tasks that need to be completed and keeping separate lists or folders for each category, your list will be easier to tackle. Another advantage is that performing like tasks together makes them easier to accomplish. Handling a number of telephone calls or emails at once is usually more efficient than handling them piecemeal. Writing several letters about the same topic (i.e. follow up to clients for documents or information youre waiting for or letters to clients about payment) or closing a number of files at once will make each individual task go faster. Prioritize the items on your list Which activities bring the highest return? Which are the most important to you or to your clients? Which activities are the oldest (sometimes getting those old dogs off of your plate makes a lot more room physically and emotionally for you to get other things done)? Those are your priority activities. Some strategies for determining the priority of tasks include asking why youre doing that task in the first place, and ensuring that the task has a legitimate purpose and focusing on the outcome or anticipated result, rather than the task itself. You probably have tasks on your list that are priorities that you avoid because you dont like to do them. Sometimes those tasks can be delegated and sometimes they cant (see below). When they cant, focus on the result, rather than on the task itself. If youre avoiding a job, chore, etc., focus on the outcome what will it feel like when this is done? What will be the result emotionally, productively, financially, or organizationally? If the task has an important purpose and a high value result, make it a priority. Eliminate unnecessary tasks Which activities can you get off of your list? Get rid of anything that you dont have to do. Some tasks can be eliminated entirely. Others can be delegated. Knowing your strengths and weaknesses can help you to determine what you should delegate. Anything that you avoid doing, hate doing or just dont do well is a potential candidate for delegation. If someone else can do it better, faster, more consistently, delegate it. Delegate it if someone else will get it done well enough (as opposed to keeping it on your to do list where it never gets done). See my article, Too Much to Do, Too Little Time? Determine the amount of time each activity will take to accomplish and schedule itDont be stingy with your estimate; estimating too little time will add stress and confusion to your schedule. Decide when you will perform that activity and physically schedule it on your calendar Make sure you leave some empty space or downtime on your calendar, in addition to the personal and family time that you schedule. Scheduling tasks can be done by scheduling a specific time for a particular task (i.e. I will call this client at 3 p.m. on Tuesday or I will draft the contract at 10 a.m. on the 27th) or by using a method known as time blocking. Time blocking can be as simple as putting like activities together, which is why the first step of categorization is so important. Often, when youre doing one task for one client, its that much easier to do the same activity for another client. For example, you can time block by saying that Thursday afternoons will be reserved for errands, or the last Friday of every month will be used for closing files, or you will focus on business development every Monday. At the same time, recognize that the schedule is not entirely set in stone. As a lawyer, it is likely that there will be last minute emergencies, unforeseen circumstances or client crises that must be addressed. Thats further evidence that what doesnt get scheduled and isnt urgent, isnt likely to get done. More often than not, you probably react to whatever is in front of you, rather than determining in advance what you want to accomplish. If scheduling time on your calendar for important tasks allows you to complete them even half of the time, its probably a lot more than youre doing right now. The advantage to setting specific times to accomplish important tasks is that as soon as the crisis or emergency has passed, you can return to your schedule without missing a beat. Leaving your schedule to chance is much more likely to deteriorate. Scheduling or time blocking gives you a purpose or plan for every day. One of the reasons many lawyers get discouraged and feel overwhelmed is that they keep one long to do list and theres no way that theyll be able to accomplish all of the tasks on the list. They continue to carry the same things on their to do list day after day. Theres no sense of accomplishment, because they see the same tasks carried from one day to the next, over and over. By using the method outlined above and making appointments with yourself, whether at specific times or in blocks of hours or days, you will be able to see when youre about to overload a specific day or week and make adjustments ahead of time. If you see that one day is already booked, youll know you need to put the new task on another day, or reschedule an existing appointment. Some final tips: Minimize interruptions or unplanned activities Just because the phone rings doesnt mean you have to answer it, and you dont need to answer every email as it arrives. Often, we waste time addressing issues or interrupting the flow of our work by being distracted by an unrelated (and often unimportant) email or telephone call. Frequently answering the email or phone call takes longer when were in the middle of something else. The same goes for interruptions from colleagues or employees; if it isnt a crisis, ask them to come back at a specific time when you can focus on their issue. Dont multitask Our society has become one in which multitasking is seen as a good practice. In fact, studies have shown that (with few exceptions) the more you multitask, the less attention and focus youre devoting to any of the tasks youre trying to accomplish. Chances are that youre performing any of those tasks well. Focusing on one thing at a time ensures more efficiency, effectiveness and satisfaction. Reward yourself There is no such thing as being done; there will always be more work to do. Its easy to focus on what hasnt been done yet, and what still needs to be done, or what should have been done. Focus instead on what youve accomplished and how far youve come. Celebrate when you accomplish something or stick to your schedule and forgive yourself when you lose track. Get back to the schedule and move on. Repurpose Everything you do should be able to be used more than once. Keep track of the legal arguments, motions, documents, letters, procedures, articles, etc. Almost everything in your practice can be used over again, either by you or by someone else in the office. If you can use the same product over again with minimal modifications, youll free up more time, rather than constantly reinventing the wheel. Take breaks and incorporate personal time No breaks and no time for yourself = burnout. Need I say more? Set deadlines A goal isnt worth much unless theres a deadline. The same is true for a task. Thats why scheduling the task for a specific time on your calendar makes it more likely that youll complete it. Get a buddy/accountability system Your buddy may be your spouse, your assistant, your best friend, another lawyer in your office, or a coach or consultant. Find someone with whom to share your goals and intentions and to keep you on track, to help you stick to your schedule and identify which tasks are priorities and which can be delegated. When you tell someone else what youre going to do, the peer pressure can be a big motivator. Create some way to keep yourself accountable. Dont get overwhelmed with all you have to do, and dont overwhelm yourself with a never-ending to-do list. Categorize, break tasks down into smaller chunks or parts, prioritize, eliminate or delegate what you can and schedule the just the first step of what remains, rather than the entire project. By Malton A. Schexneider Stable Blood Sugar In our discussion of the macronutrients, we mentioned the concept of stable blood sugar levels. What does a stable blood sugar level mean and how is it important in a healthy weight loss program? When you consume carbohydrates, your body experiences a spike in blood sugar levels due to a rise in glucose in your bloodstream. In response to this rise in glucose levels, the pancreas releases the hormone, insulin. Insulin is necessary in the right amounts to maintain a healthy blood sugar level and, thus, is a necessary consideration in a healthy weight loss program. However, when excessive amounts of carbohydrates are ingested, particularly high glycemic (sugar content) carbohydrates, insulin converts the excess glucose in the blood into triglycerides (blood fat) that are then stored in the fat cells. This creates a sudden drop in glucose levels (hypoglycemia) that in turn results in the release of cortisol. Cortisol is a dangerous hormone that actually kills brain cells, increases fat storage, and breaks down lean muscle mass. So, how do we control our blood sugar levels, stop storing fat, and start burning it? The answer is found in two easy steps: Choose low/moderate glycemic index carbohydrates. Combine these carbohydrates with a protein or essential oil/fat. The combination and balance of a protein and carbohydrate trigger the release of another potent hormone, glucagon. Glucagon, like insulin, maintains a healthy blood sugar balance. However, unlike insulin, glucagon promotes fat burning and mobilization. Feverfew A Herb To Stop Migraine Headaches

By Mary Hanna The Feverfew herb is a member of the daisy family. Feverfew has instilled new hope for fewer and milder migraine headaches. In ancient Greece the herb Feverfew was used to reduce swelling and for women’s menstrual distress. The herbs name is a Latin derivative meaning to chase away fevers. You may even say it was the aspirin of the eighteenth century. It was used to treat fevers, menstrual and rheumatic pain. Herbalists stopped using the herb for a few hundred years, but now the herb Feverfew is being used to combat migraine headaches. The plant grows to about two feet high and it is a perennial. The leaves are doubly divided and have a tooth like edge. The flower will look very much like a daisy with white petals and a yellow center. Feverfew requires lots of sun and good drainage; it is very easy to grow and is considered a weed. There was a time when the whole plant was used medicinally, now only the leaves of the Feverfew are used. It is best to harvest the herb before the plant flowers. Pick the leaves and either dry them or freeze them. The Feverfew leaves will have a strong, bitter, and aromatic scent. Migraines are still a mystery to the medical and holistic community. But there have been many studies done on the herb Feverfew. Over aggregating of platelets in the blood appear just before a migraine forcing a release of serotonin. Serotonin causes the blood vessel to dilate. Feverfew, or more correctly the parthenolide contained in it, will stop over-aggregating keeping the blood vessel normal resulting in less painful, less frequent or cessation of migraines. After many studies the compound in Feverfew is parthenolide which inhibits the brains chemicals that dilate blood vessels. Use three to four leaves to make an herbal tea. The leaves have a bitter taste so you might want to stir a little honey in the tea. You could also make a tincture using 1-2 teaspoons daily. There are no side effects except some people said that chewing on the leaves gave them mouth sores. If your migraines are chronic you need to find what is triggering them. Keep a migraine diary and write everything you did on each day. Record what you ate, how you slept, even what you smelled and how you feel. Compare the days when you did not have a migraine to the ones when you did have one. Compare several days together. You should be able to tell what is affecting you before an onslaught of the migraine. If you don’t want to grow the herb, there are herbal compounds available. There are a few things that are crucial when buying a herbal supplement with Feverfew. First, try to get a product that has about .7% of parthenolide, remember this is what makes feverfew effective against migraine headaches. Many Feverfew supplements have varying amounts of parthenolide, .7% is good amount. Two other components should be in the tablet. Riboflavin, or Vitamin B-2, keeps your co enzymes stable, they are necessary for keeping your brain functioning well. There are studies being done to see if Riboflavin could be used on it’s own to treat migraines, but it seems to be more effective with the other two ingredients. Magnesium is the third ingredient that you should find in the supplement. In many of the studies of it is showing to be a critical component for people who suffer from migraine headaches. Without magnesium, in your body you will lack sleep, develop stomach pain, shorten you breath or make you feel weak. It has been shown to lessen migraine pain. There is one product that I have seen recommended time after time and that is MigreLief. I do not work with that company and get no financial gain by mentioning them in this article. You can find it in health food stores and on the internet. This migraine therapy must be done daily and will take at least four weeks for you to see a difference. Isn’t worth four weeks worth it to lessen and perhaps eliminate migraine pain? It may take up to three months to see a serious benefit for you and to get rid of those awful migraine headaches.
